Warranty Terms and Conditions – Enbio Technology Sp. z o.o. 


1. Enbio Technology Sp. z o.o., located at ul. Północna 10, 81-029 Gdynia, REGON: 191317763, NIP: 9580982035, registered with the District Court in Gdańsk, 8th Commercial Division, under KRS number: 0000214555, hereinafter referred to as the “Guarantor,” provides a warranty for the device, provided that it is used in accordance with the intended purpose specified by the Guarantor and the recommendations contained in the User Manual. 
2. The warranty is provided within the scope and under the terms and conditions set forth below and may not be interpreted in a broader sense.  
3. Warranty obligations are fulfilled by the Guarantor or a service provider designated by the Guarantor. 
4. The warranty period is 24 months or 4,000 sterilization cycles from the date of sale—whichever comes first—for devices used in European countries and Japan. The date of sale is deemed to be the purchase date stated on the invoice provided directly by the Warrantor or an authorized Distributor. Under this warranty, the Warrantor does not provide any warranty and assumes no liability for equipment purchased by end users from unauthorized distributors. A list of authorized distributors for the equipment is available at www.enbio.com.  
5. The warranty is considered valid if it is supported by a purchase invoice issued by an authorized Distributor and containing the autoclave’s serial number and a clear date of purchase. No other forms of validation will be accepted.  
6. The Warrantor does not provide a warranty for equipment, components, and/or accessories supplied by the Warrantor along with the device that do not constitute an integral part of the device.  
7. The Warrantor provides a warranty for defects discovered during the warranty period and arising from the fault of the manufacturer (the Warrantor) regarding design, defects in materials used, and errors in workmanship and factory assembly. The scope of the warranty also covers the costs of repair, delivery, and replacement of parts, as well as the procurement of parts or components necessary for the proper performance of the warranty service. 
8. The Guarantor’s obligations under this warranty consist solely of repairing the defective device and providing the other services specified in section 6 above. 
Repairs performed by the Warrantor or an Enbio Authorized Service Center as part of warranty service are covered by a 12-month warranty period for the replaced components, calculated from the date of delivery of the repaired device or in accordance with the warranty in effect at the time of purchase—whichever period is longer. 
9. For the avoidance of doubt, the Parties agree that the warranty services provided by the Warrantor under this warranty do not include an obligation to replace the device with a new one. Replacement of the device with a new one, if performed, occurs solely at the user’s request and with the Warrantor’s consent, and does not constitute fulfillment of the warranty obligation under this warranty. If the device is replaced with a new one, the warranty period does not restart. The warranty period is extended only by the time during which the user was unable to use the device—but no longer than from the date the defect was reported to the date the replacement device was delivered. A device that has been replaced pursuant to an agreement between the Warrantor and the user becomes the property of the Warrantor. 
10. Replaced parts of a device covered by the warranty become the property of the Warrantor. 
11. The Guarantor’s employee’s determination regarding the causes of the defect is not binding if the user submits, within 14 days of returning the device, an opinion from an independent expert confirming a different diagnosis. 
12. Upon expiration of the warranty period, the Guarantor’s liability as set forth in this document shall cease. 
13. Under no circumstances shall the Guarantor be liable for damage to or malfunction of the device resulting from: 
a. operational error, improper maintenance, or use inconsistent with the guidelines 
contained in the User Manual; “improper use” is understood to mean, in particular, the 
use of water in the device with parameters inconsistent with the guidelines contained in 
the User Manual, or 
b. making modifications, alterations, repairs, or replacing parts on one’s own without the 
Guarantor’s consent, which must be provided in writing at a minimum. 
14. If the Warranty Provider determines that: 
a. that water with parameters inconsistent with the guidelines contained in the User Manual is being used in the device, or 
b. the removal or damage of the warranty sticker on the device’s housing, if the removal of the sticker prevents the product from being identified or affects the assessment of its 
operation, 
c. the device has been connected to an inappropriate power source,  
The Warranty Provider may refuse to provide warranty services. 
15. The warranty does not cover parts subject to normal wear and tear and/or consumables that wear 
out before the end of the warranty period, in particular: 
a. front seal 
b. HEPA filter 
c. chamber filter. 
16. This warranty does not cover losses caused by downtime in the operation of the device by the user, nor does it cover property damage or non-property damage caused in connection with such downtime. 
17. The document entitling the user to warranty service is the sales receipt specified in section 4 above and the repair document in the cases specified in section 8. 
18. A list of authorized Enbio service centers is available at on the website www.enbio. com. 
19. Any changes to the Guarantor’s contact information specified in section 1 above are updated on the Guarantor’s website and do not require an amendment to this warranty statement. 
20. All costs associated with an unjustified warranty claim, including claims for defects in devices not covered by this warranty statement, shall be borne by the claimant.  
21. This warranty covers only devices that have been paid for in full. The Warrantor may refuse to provide warranty service if it is determined that the price for the devices submitted for warranty service has not been paid, and may make the provision of service contingent upon payment of the price, without affecting the repair timeline. 
22. In matters not covered herein, the provisions of Polish law shall apply. In particular, in the event that the sold item does not conform to the contract, the buyer is entitled by law to legal remedies at the seller’s expense, and this warranty does not affect the legal remedies available to the buyer.
